Current Information Concerning the Proposed Schedule Change at Orion Assembly

 

In light of the recent General Motors announcements concerning our schedule and future operations at Orion Assembly, following is information regarding these issues from the International UAW and from your Local Union Leadership.

BARGAINING UNIT QUESTIONS

       QUESTION: Time for Time, do you lose any or all seniority after the 6 months is over with no call back.

        ANSWER:  National Agreement (Pg. 49) Para: 64 (e) states (in excerpt)  If an employee is laid off for a continuous period equal to the seniority which the employee had acquired at the time of such lay off period  shall for a period of 60 months, beginning with the employees last scheduled work day prior to being laid off, retain the right to re-hire in accordance with the seniority date that the employee has established at the plant as of such last day scheduled.  (The Nation Agreement Para : 64 is suggested reading to explore your individual circumstance)

QUESTION: Will everyone hired in 2008 be laid-off?

      ANSWER:  As things stand right now, everyone with 2008 plant seniority will be laid off, some time, after February 2, 2009 .

QUESTION:  Would you clarify the 6 year call back.

      ANSWER:  Please see answer #1

QUESTION:  When will vacation forms be approved and how will they work considering the changes?

ANSWER:  Management is currently processing vacation forms.  Make sure you have your vacation form before leaving for the Christmas                         Holiday .

QUESTION: Would a SAP program include GM Suppliers?

ANSWER:  There has been no official Special Attrition Program announcement or offer by management, when and if there is, the rules and        conditions will be rolled out at that time.

QUESTION:  When you are laid off for 48 weeks is it true you would be brought back and someone else would get laid off?

 

ANSWER:  National Agreement (Pg. 199 )Appendix K states: (in excerpt) Para: I (A) (1) Volume related declines attributable to market related conditions as described in Doc. #10, Jobs Program – Volume Related Layoffs – SEL, not to exceed 48 weeks  (inclusive of vacation shutdown weeks) over the life of the agreement.  A Layoff caused by an event described in Para: I (A) will have no impact on the number of protected employees except for an employee who is protected from a lay off attributable to a market related volume decline in excess of 48 weeks (inclusive of vacation shutdown weeks) In those instances, employees having the least seniority, will be laid off and replaced by an equivalent number of greater seniority employees who would otherwise have insufficient seniority to remain in the plant.  (The National Agreement (Pg. 199) Appendix K is suggested reading to explore your individual circumstance)  Appendix K, in full, describes the Job Security program.  In light of the recent comments by UAW International leadership these provisions could be thrown in to the special circumstance described in Appendix K I (A)

 

QUESTION: Do Members of UAW Local 5960 pay union dues while on lay-off?

 

ANSWER:  Laid-off members, who receive Sub-Pay, pay 1 Hr. of their hourly wage Per Month from their Sub-Pay check.

 

QUESTION : Can General Motors call Temporary Employees back prior to Permanent Employees being called back?

                                       ANSWER:  No.  UAW  National Agreement Pg. (41) Section (56) (in excerpt) Employees shall be regarded as temporary employees until their names have been                                     placed on the seniority list.  There shall be no responsibility for the re-employment of temporary employees if they are laid off or discharged during this period.

                                        QUESTION :Do employees from Orion Assembly get called back prior to other GM employees from other GM Locations being called?

                                       ANSWER: Yes.

ANSWER:  Yes.        QUESTION :   Can you explain a “Cold Shut Down.”

                                

                                 QUESTION : What plants have currently been scheduled for closing or consolidation?

                                        ANSWER:  Janesville, Wisconsin, Doraville, Georgia, Oklahoma City, Oklahoma, Linden, New Jersey, Massena, New York, Livonia, Michigan,                                  Drayton Plains, Michigan, Lansing Craft Centre, Michigan, Portland Oregon POC and St. Louis, Missouri CTR.

                                 QUESTION : Will Orion Assembly be down the 22nd and 23rd of December?  

                                       ANSWER:  All shifts will report on December 22nd, 2008 .  The system will be built out and employees will be released, per department, once the shutdown          

                                       requirements have been met.  

               

                                     QUESTION :  What is happening with job postings and transfers at this time?

                                      ANSWER:  All job postings and 63b’s have been suspended as of Monday December 15, 2008 , due to the upcoming reduction in force.  Job Postings and 63b’s will                                       resume in February.

                                       QUESTION :  Regardless of seniority, are Tier 2 employees laid off before Tier 1 employees?  

                                      ANSWER:  Yes, Tier 2 employees have less seniority than Tier 1 employees.  Tier 1 employees are laid off by seniority.  Tier 1 and 2 employees are called back to                                       work in line of seniority.  UAW 5960 Local Agreement Pg. (26) A- 5 (in excerpt)  Thereafter, employees with the greatest seniority will be                                              retained and employees with the least seniority will be reduced in accordance with the Orion Assembly Center flow charts (Pg. 51) Reduced on a high                                            to high seniority basis.  

                                    QUESTION :  What is the status of inverse seniority layoffs?

                                     ANSWER:  The UAW Local 5960 leadership and Orion Assembly Management are currently discussing inverse seniority layoffs.  

                                      QUESTION :  Is the current seniority list up to date and where is it?

                                     ANSWER: In accordance with the UAW 5960 Local agreement, seniority lists are posted at the East, South, North and Main entrances and in the A aisle near the Main                              Cafeteria in an enclosed bulletin board.

                                     QUESTION :  I transferred her from another factory out of the area, when I am indefinitely laid off can I take the relocation money to transfer back if my                                            application is accepted?

                                      ANSWER:  UAW/GM National Agreement Pg. (171) Appendix A I – H (In excerpt) Employees who are placed in accordance with Appendix A and accept                                            the Enhanced Relocation Allowance will not a eligible to initiate another Extended Area Hire Placement for a period of 36 months unless the employees                           status changes to laid off or Protected.  In the event the plant has excess employees on permanent indefinite lay off or placed on Protective status with no                                            likelihood of recall into the active workforce, the 36 month period will be eliminated.

                                     QUESTION :  How many jobs is the partial 3rd shift expected to keep around?

                                     ANSWER:  The partial 3rd shift operations, as of this time, will require approximately (57) fifty seven additional employees.
